Welcome to States of Mind

By using the statesofmind.org website and the States of Mind service, including the States of Mind online education programme you are agreeing to be bound by the following terms and conditions (“Terms of Use”).

These Terms of Use may be updated by us from time to time.

Basic Terms

You must be 11 years or older to use this site.

You are responsible for any activity that occurs under your screen name (“Username”) including direct submissions to STATES OF MIND CIC.

You are responsible for keeping your username secure.

You will not share phone numbers, home addresses, e-mail addresses or other personal information on the public areas of our site or our online education programme.

You will use States of Mind for entertainment or educational purposes only. You will not make critical decisions based on feedback or advice from the States of Mind community.

You consent to our processing your personal data, including the retention of your email address for any correspondence and the anonymisation of your data for research purposes.

You may not post offensive, abusive or harmful content.

You must not abuse, harass, threaten, impersonate or intimidate other States of Mind users or use another person’s account to gain access to our site or our online education programme.

You may not use the States of Mind service for any illegal or unauthorised purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.

You will not distribute or post spam or other unauthorised commercial communication on or through our site or our app.

You must not modify, adapt or hack States of Mind or modify another website so as to falsely imply that it is associated with States of Mind.

You must not access States of Mind’s private API by any other means other than the States of Mind website itself.

You must not crawl, scrape, or otherwise cache any content from States of Mind. You must not transmit any worms or viruses or any code of a destructive nature.

If you notice any user acting in violation of these rules please report this immediately to our system administrators via our contact form.

We reserve the right to remove content and/or delete your account at our discretion, including if you violate any of the terms of this Agreement.

Services

The services provided by the www.statesofmind.org (“website”) are mainly the following:

A general information service in the field of mental health, wellbeing for personal and social issues;

A personal digital handbook for user to document problems, ideas, experiences, support and solutions.

Written articles and information concerning mental health and wellbeing;

It’s currently free to register for States of Mind services, although the cost of connecting to the Internet is the responsibility of Users. However, STATES OF MIND CIC reserves the right to charge subscription fees for optional additional services, subject to prior approval by Users.

Services provided via States of Mind are not a substitute for consultation with competent health professionals. Users should never, as a result of information read via the States of Mind Online education programme or website, neglect the medical advice of their doctors or of other qualified professionals responsible for their healthcare. It is important to note that STATES OF MIND CICcannot assess the health of individual Users using the data they submit via the website. In an emergency, users should contact their doctor immediately or call an emergency number such as 999.

Although States of Mind makes all reasonable efforts to regularly update information distributed by the website, such information is strictly indicative and general in character and cannot be perfectly error-free. The online tools available to Users do not in any way constitute a medical device nor an act of telemedicine. STATES OF MIND CIC does not verify or control the content or suitability (including scientific, medical or health plans) of data entered by users. STATES OF MIND CIC does not endorse or recommend any specific methodology, advice or procedure, health profession, products or service that may be mentioned on the Online education programme or website. Users and third parties use information provided via the Website and the online education programme at their own risk.

Moderation and monitoring

All content submitted in the online education programme is moderated. The purpose of moderation is to:

By using our website and our Online education programme, you acknowledge and consent to our monitoring as described in these Terms of Use. You expressly agree to waive any rights of confidentiality that you may have in, and to, your communications (if any) when using our site and our online education programme and you agree that you have no expectation of privacy in any of those communications.

Communication

In accordance with our Privacy Policy, we may contact you via email regarding administrative issues, including improvements to our site and our app. In addition, States of Mind may send you emails with content from the States of Mind community, such as our newsletters or with suggestions for specific support services that we think might be useful for you. In general, by using States of Mind and agreeing to these terms, you are agreeing to be contacted by States of Mind via email with general communications. We won’t abuse this right and will endeavour to provide you with valuable information, however, in accordance with our Privacy Policy you may opt out of receiving such communications at any point by clicking on the “unsubscribe” links in any of our emails.

Personal Data

Our site and our online programme are for your personal use only and shall not be used by you directly or indirectly in connection with any academic, commercial or governmental endeavour. If you would like to advertise, conduct market research or other survey or research activities for academic, commercial or political purposes please contact us.

By using our services you are agreeing to permit your data to be used by us or approved third parties in an anonymised form to further research into mental health and wellbeing or to improve our services.

Users have, under Part II of the Data Protection Act 1998, a right of access to personal data concerning them, and to its rectification, opposition and deletion, which you can exercise by writing to us by email at info@statesofmind.org

Copyright and Trade Mark Ownership

You own all the content you submit on our website and on our Online education programme and give us a perpetual, royalty-free, right to a licence and sub-licence throughout the world to collect, reproduce, publish, distribute, display, transmit, modify and otherwise use your posted content on our site and our online education programme, and for our own internal purposes.

Ownership of any materials that you submit directly to us for use on the website or the Online education programme, for example images for our educational resources, will transfer to us on acceptance of the material. We are under no obligation to pay you for submitted materials without prior agreement.

Aggregated and compiled content available through our website or our online education programme is the property of STATES OF MIND or its licensors and may be protected by English and/or international copyright laws. The collection, arrangement and assembly of all content is the exclusive property of STATES OF MiND CIC and protected by English and/or international copyright laws. We grant you permission to share this information via provided utilities (i.e. Facebook), electronically copy, and print copies of content for personal use only. Any other use, including the reproduction, modification, distribution, transmission, republication, or display of the content is strictly prohibited. If you use material other than as permitted by the terms of this Agreement, you may be liable for infringement, misappropriation or other causes of action to the fullest extent of the law.

Other than the personal use licensed above, you may not reproduce any content in any form without first obtaining written permission.

All trademarks, logos, service marks and trade names are proprietary to STATES OF MIND CIC or third parties who have granted STATES OF MIND CIC the right or license to use such intellectual property. STATES OF MIND CIC does not grant, by implication or otherwise, any license or right to use any trademark, service mark, trade name or logo displayed without our prior written consent.

Our tools may contain links to other websites. The linked sites are not under States of Mind’s control, and we do not warrant, represent or assume any responsibility or liability for the accuracy or completeness of the information or software or other materials downloaded from or contained in any linked site or any site contained in a linked site.

Disclaimer, Warranties and Liability

You acknowledge and agree that your use of our website and our online education programme are at your sole risk. To the fullest extent permitted by law, neither STATES OF MIND CIC nor its officers, directors, employees, agents, successors or affiliates will be liable to any user of our site or our app or any other person or entity for any:

(a) indirect, special, incidental, punitive, consequential or exemplary damages;

(b) loss of profits;

(c) loss of data; or

(d) loss of use,

in each case, arising out of the use or inability to use our site or our app, even if we have been advised of the possibility of such damages, except where liability cannot be excluded in accordance with applicable law.

For any direct losses you or any other person may suffer in connection with your use or inability to use our site or app our liability will be limited to the fullest extent permitted by applicable law to £100.

To the extent permitted by applicable law, STATES OF MIND CIC disclaims any implied warranties of fitness for any particular purpose regarding our site or our app.

STATES OF MIND CIC will accept no liability for advice provided by any medical professionals.

We cannot always foresee or anticipate technical or other difficulties. These difficulties may result in loss of data, settings, or other service interruptions. For this reason, you agree that States of Mind services, including the services of our third-party service providers, are provided “as-is” and we do not guarantee the availability of the States of Mind services or that any of the features or services will not be interrupted or will be error free.

Law The States of Mind service was designed for Users resident in the United Kingdom. English law governs these general conditions. Foreign (including Scottish) Users expressly accept that by using the website and the App English law shall apply and any dispute arising from their use shall be litigated only in England and Wales. Accordingly, Users acknowledge that generally any information that is disseminated to, and / or exchanged via the States of Mind services may not be appropriate outside England and Wales.

Notices

Except as otherwise stated, any notice to us shall be given by email to info@statesofmind.org and any notice to you shall be given to the e-mail address that you provided us during the registration process. Notice shall be considered given the next business day after an e-mail has been sent.

General Conditions

We reserve the right to modify or terminate the States of Mind service for any reason, without notice at any time.

We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via internet mail according to the preference expressed on your account. What constitutes a “material change” will be determined at our sole discretion, in good faith and using common sense and reasonable judgement.

We reserve the right to refuse service to anyone for any reason at any time.

We reserve the right to force forfeiture of any username that becomes inactive, violates trademark, or may mislead other users.

We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use.

We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.
